Sample “Municipal Code For Small Cell Infrastructure,” 5G Technology

SNLS | January 14, 2019

By Catherine J. Frompovich

The group I network with, Americans for Responsible Technology  regarding 5G, has formulated a “Municipal Code for Small Cell Infrastructure” or the Sample Code for Villages and Towns • Social Media Ideas • Blumenthal & Eshoo • Lobbying Basics, which I share with my readers, and ask you to do the same with your work in the push back against 5G.

The folks at ART graciously have given permission to share and publish the Code, which is found in this 8-page PDF file.

The Introduction to the Code states this:

This document is intended for use by towns and villages that have existing code for cell towers and other wireless communications infrastructure developed and adopted prior to the introduction of “small cell” equipment and its widespread deployment on public rights-of-way. We note that the proposed deployment of small cell infrastructure for 5G will result in the installation of a large number of wireless microwave antennas in every community, many of which could be located in close proximity to homes and apartments, impacting many residents and resulting in much greater citizen concern about placement and negative impact on property values. Moreover, as technology improves, the need for locating antennas in such close proximity to homes and apartments may decline; therefore, municipalities should endeavor to limit, to the extent possible, the deployment of small cells in close proximity to residential dwellings. DISCLAIMER: This draft document is provided for informational purposes only, and is not intended to substitute for legal advice regarding zoning regulations or code compliance with local, state or federal law. Americans for Responsibility makes no assurances or guarantees regarding the suitability of this language for any municipality, and shall not be held responsible for any legal action arising from the use of language or concepts contained herein. Local municipalities should be aware that sample ordinances offered by wireless telecommunications companies, their subcontractors or organizations they sponsor are generally not protective of the rights, welfare and property of local municipalities, their homeowners and other residents.

The Code includes:

Section 1: Findings
Section 2: Definitions
Section 3: Permitting and Leasing Process
Section 4: Location and Configuration Preferences
Section 5: Installation Specifications
Section 6: Applicability
